Terms of Service
These terms are an agreement between you and TTI One, LLC, a Texas limited liability company ("we," "us"), which makes the Chowdar iPhone app (the "App"). By downloading or using the App, you agree to them. If you don't agree, please don't use the App.
1. Who can use Chowdar
You must be at least 13 years old to use the App. If you're under the age of majority where you live, use it with a parent or guardian's involvement.
2. What Chowdar is
Chowdar helps you discover restaurants and food events in the Houston area: new openings, closings, news coverage, events, and lists. We gather this information from publicly available sources. We aren't affiliated with the restaurants, venues, or event organizers in the App and don't endorse them unless we say so. We aren't part of any purchase, reservation, or visit between you and a business.
3. Check before you go
Hours, prices, menus, ratings, open or closed status, and event dates come from third parties and change often. They may be out of date or wrong. Please confirm with the business or organizer before you go, especially for anything that matters to you, such as allergies, accessibility, or a long drive. If you spot a mistake, tell us and we'll fix it.
4. Chowdar Premium
Chowdar Premium is an optional, auto-renewing subscription, available monthly or yearly. The current price is shown in the App before you buy.
- Payment is charged to your Apple ID when you confirm the purchase.
- The subscription renews automatically at the same length and price unless you turn off auto-renew at least 24 hours before the current period ends. Your Apple ID is charged for the renewal within 24 hours before the period ends.
- If a free trial is offered, it turns into a paid subscription when it ends unless you cancel at least 24 hours before then. Any unused part of a trial ends when you buy a subscription.
- Manage or cancel any time in iPhone Settings › your name › Subscriptions. Deleting the App doesn't cancel a subscription.
- Apple handles billing and refunds under the Apple Media Services Terms. We can't issue refunds directly; you can request one at reportaproblem.apple.com.
- Family Sharing is supported, so members of your Apple family group can use your subscription.
We may change Premium's features or price. A price increase applies only after Apple notifies you and, where Apple requires it, after you agree.
5. Reservations, tickets, and other services
Buttons such as Reserve, tickets, websites, maps, and Instagram take you to services run by other companies (for example OpenTable, Resy, Tock, Google, or a ticket seller). Their terms and policies apply to what you do there. We don't control those services and aren't responsible for bookings, tickets, cancellations, or charges made through them.
6. Using the App fairly
You agree not to:
- use the App for anything unlawful;
- scrape, copy, or redistribute the App's content beyond what the App lets you do, such as sharing a spot with a friend;
- interfere with or overload the App or the servers behind it; or
- reverse-engineer the App, except where the law allows it.
7. Ownership
The Chowdar name, logo, design, and our original writing belong to TTI One, LLC. Restaurant names, logos, photos, and articles belong to their owners and appear only to identify the business or point you to the source. If you own content in the App and want it corrected or removed, email ilovetoeat@chowdar.com.
8. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DON'T PROMISE THAT THE APP WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT ANY LISTING IS ACCURATE OR CURRENT.
9. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, TTI ONE, LLC AND ITS OWNERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF, OR INABILITY TO USE, THE APP OR YOUR RELIANCE ON ANY LISTING. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE GREATER OF WHAT YOU PAID FOR CHOWDAR PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR $50.
Some places don't allow these limits, so they may not all apply to you.
10. Indemnity
If a claim against us arises from your misuse of the App or your breaking these terms, you agree to cover our reasonable costs of dealing with it.
11. Apple
These terms are between you and TTI One, LLC, not Apple. Apple isn't responsible for the App or its content, and has no obligation to provide maintenance or support for it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. Your use of the App must also follow Apple's Licensed Application End User License Agreement.
12. Ending use
You can stop using Chowdar any time by deleting the App (and canceling Premium, if you have it). We may stop offering the App or any part of it.
13. Governing law
Texas law governs these terms, without regard to conflict-of-laws rules. Any dispute will be handled in the state or federal courts in Texas, and you agree to their jurisdiction.
14. Changes
We may update these terms. We'll change the date at the top and, for significant changes, tell you in the App. If you keep using the App after a change takes effect, the new terms apply.
